                                                                      哪些行為是虐待動物? 哪些虐待行為是可以被起訴的?
                                                                      首先建議大家應該對於 "動保法" 有基本了解, 才能有好的判斷



                                                                      觸法的行為
                                                                      (故意傷害或殺害動物,沒有提供生活環境之安全、遮蔽、通風、光照、溫度及清潔,或惡意遺棄,不照顧使其身體受傷或使其他人受傷等)

                                                                      1)聯絡警方
                                                                      如果你看到動物被虐待或殺害,請立即通知當地警察機構,虐待動物的人一般是難溝通或甚至對靠近的人具有危險性,因此在緊急或對峙的狀況,不要獨自靠近施暴人,立即打電話教警察求救。

                                                                      2)取得證據
                                                                      如果虐待案件要上法院,法官會要求照片、錄影帶、或施暴人及受傷動物的照片,你能提供越多的證據、可成立強而有力的案件。*在取得證據時千萬要小心,安全第一!!

                                                                      3)通報當地”動保單位”
                                                                      台北市動保處有30多位動保員,負責虐待/通報案件的調查及處理。警察一般無法處理虐待動物案件,但警察可以從旁協助及保護人身安全,針對調查案件,聯絡”動保處”及盡量提供他們人證物證,以利案件處理。台灣各鄉鎮城市都有類似”動保處”的單位,設置在各縣市的動物防疫所,或家畜疾病防疫所,請上SPCA網站查詢聯絡單位及電話

                                                                      4)通報台灣防止虐待動物協會
                                                                      台灣防止虐待動物協會(簡稱TSPCA)協助處理通報電話,當我們接到電話後,會盡量取得更完整的資料、實地勘查有無案件事實、SPCA會將所有證據轉交動保處人員處理,也會協助案件起訴施暴人。如果你有看見虐待動物,請撥 02-2921-7530


                                                                      哪些行為是 "違法" 的?
                                                                      單單將狗用短鏈栓住,並不違法,但並不恰當如此對待動物,狗狗是需要適當運動及活動空間,為了確保狗狗身心健康, 哪些是你可以做的?

                                                                      1)與飼主溝通
                                                                      大多數發生是基於狗飼主缺乏正確知識,或缺乏照顧所致,如果你知道主人是誰或有看到他在附近,態度客氣的詢問或提供適當建議如何可以改進,如果飼主不易溝通,不要強迫或進一步的刺探,而是聯絡SPCA。

                                                                      2)立即行動
                                                                      “個人安全”優先,在第一時間內及那環境下,你能幫動物在做什麼? 例如:如果在大熱天,你看到狗被綁在太陽下,可以提供乾淨水或幫牠找陰涼處(可用紙板遮蔽),留一紙條給飼主,告訴他你所做的及為什麼做,提醒飼主有關如何妥善照顧動物,拍照或寫下你所看到的時間地點,這些資料在有關機構介入時,可以提供最有效的幫助。

                                                                      3)聯絡台灣防止虐待動物協會
                                                                      有時案件不一定違法,但SPCA會幫忙飼主及提供建議來改善動物的生活環境及福利,提供改善建議及依據動保法的基本要求,針對有行為偏差的動物,協會也可提供訓練,以減少挫敗感及缺乏照顧。若之後飼主決定棄養,協會也會幫忙找認養人(看實際狀況而定)。

                                                                      當我們看到疑似虐待事件,盡量站在飼主立場想,大多數我們所碰到的案例都是飼主是愛牠們的,只是沒有多為動物著想,例如將動物關在籠子內是合法的,但如果動物被發現是沒有遮蔽、曝曬在大太陽下、或經神上受虐、或身體上受虐待(如生病沒有看醫生)、以上這些皆屬違法。每個人在日常生活中能夠做什麼? 多了解動物保護法,仔細觀察,提供其他動物飼主適當建議,如有看到需要幫助的動物,請積極採取行動。

                                                                      What is Considered Abuse? Which Acts Can be Prosecuted?
                                                                      Please be aware of the Animal Protection Act in order to make good judgments

                                                                      For Acts That Are Illegal
                                                                      (ex. Intentionally hurting or killing an animal; failure to provide adequate shelter, food, and water; abandonment and inadequate care by owner leading to bodily harm of others)

                                                                      1) Contact Police

                                                                      If you witness an animal being tortured or killed, contact the police immediately. Animal abusers can sometimes be hard to talk to or even dangerous should you try to approach them. Therefore, in emergency cases or hostile situations do not try to approach the abuser yourself, but call the local authorities for help.

                                                                      2) Obtain Evidence

                                                                      If an abuse case is to go to court, judges are looking for pictorial, video, and/or audio evidence of the incident, the perpetrator, and the animal. The more you are able to provide, the stronger the case will be.  *We suggest exercising caution when trying to obtain evidence. SAFETY FIRST!

                                                                      3) Contact the local Animal Protection Office

                                                                      Taipei City has an Animal Protection Office with 30+ officers in charge of investigating cases of animal abuse and/or neglect. The police often times is unable to handle animal abuse cases themselves, but instead offer assistance and/or protection during investigations. To investigate/prosecute a potential offender of the law, contact the APO and be sure to provide them with witness statements and any evidence you were able to obtain. Each city/county in Taiwan has a similar institution to the Taipei Animal Protection Office though some may be smaller offices under the Council of Agriculture responsible also for animal and plant quarantine.                                                                       4) Contact Taiwan SPCA
                                                                      The Taiwan SPCA deals with various kinds of reports ranging from dogs tied up outside to cases where people deliberately strike a dog with a baseball bat. When we receive a call our role is to obtain as much information as we can from the caller, visit the premises or location reported, assess the condition of the animal, offer support or help, and work to collect evidence should it be a possible abuse case. The Taiwan SPCA works closely with the Taipei Animal Protection Office and presents investigation reports to them along with evidence, and assists the APO in prosecuting offenders of the law.                                                                       For Acts That May Not be Illegal by Law:
                                                                      (ex. Tying a dog up, confining an animal to a cage, keeping dogs on a balcony all day)

                                                                      Though tying up a dog on a short chain, for example, is not illegal in Taiwan, it does not mean that it is an adequate or right way to treat an animal. Dogs need plenty of exercise and space to move around, in order to ensure physical and mental wellness. Things you can do to help are:

                                                                      1)Talk to the Owner
                                                                      In most cases it is a lack of knowledge or effort by the owner that results in a mistreatment of an animal. If you know who the owner is or see them around, politely ask them about their animal and offer advice or suggestions as to how the situation of the animal can be improved. However, if the owner seems hard to communicate with or offended, do not push or pry any further but contact the Taiwan SPCA for assistance.

                                                                      2)Immediate Actions
                                                                      With your own safety in mind, see what you can do for the animal to relieve its stress or situation at the immediate moment. For example, if you see a dog tied up outside on a hot summer day, offer it fresh water or find shading for it, such as a cardboard box. Leave a note for its owner about what you did and why you did it, so as to remind them of proper animal care. Take pictures and/or write down the time you saw the animal and its location. If authorities or organizations such as the Taiwan SPCA are  to offer assistance, the information you provide will assist them in helping the animal.

                                                                      3)Contact Taiwan SPCA
                                                                      Though a case may not be illegal, the Taiwan SPCA will work to help owners and offer guidance and support for owners to improve the living conditions and welfare of their animal. Suggestions for improvement are provided and animal protection laws are reminded with follow-up inquiries made. Training courses are offered to those who have dogs with behavioral problems, which may be what stems their frustration and lack of care. If after working with the owner, he/she still decides not to keep the animal SPCA will offer re-homing assistance (on a case-by-case basis).

                                                                      *It is important to remember that when you spot potential abuse, benefit of the doubt should first be given to the owner. Many times in the cases that we have seen, owners actually love their animals but are just not aware of the right ways to care for them. Though certain actions, such as confining a dog to a cage is not illegal, if the animal is found to be unprotected from the elements (Ex. shading from the sun, shield from rain) or is suffering from mental or physical distress (Ex. sick and/or hurt without medical attention) it could still be deemed as a criminal act. What everyone can do on a daily basis is to be aware of the laws, keep your eyes open, offer advice to other pet owners, and be pro-active when you see an animal that needs our help.
